Welcome to Toda Moda. These Terms of Service ("Terms") apply to your use of this website and to any purchase you make from us. By using the site or placing an order, you agree to these Terms. If you do not agree, please do not use the site.

1. Who we are

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order. By ordering, you confirm that the information you provide is accurate and complete.

3. Products and product information

We describe our fragrances as accurately as we can, including their notes, scent family and intensity. How a fragrance smells and how long it lasts varies from person to person.
Product images are digital renderings created to show each product. Colors can look different on different screens, and packaging details may vary slightly.
Our products are cosmetic fragrances. They are not intended to diagnose, treat, cure or prevent any condition. Please read the ingredient list on the packaging before use, and do a patch test if you have sensitive skin or known allergies.

4. Prices and availability

All prices are in US dollars and exclude sales tax. Applicable sales tax and shipping charges are shown at checkout before you pay. We may change prices or discontinue products at any time. A price change does not affect orders we have already accepted. If a product is listed at an incorrect price because of an error, we will contact you before shipping, and you can confirm the correct price or cancel for a full refund.

5. Orders and acceptance

Your order is an offer to buy. We accept it when we send you a shipping confirmation. We may decline or cancel an order, for example if an item is unavailable, if we cannot ship to your address, or if we suspect fraud. If we cancel an order after you have paid, we will refund you in full.

6. Payment

Payment is taken at checkout through our secure payment provider. You confirm that you are authorized to use the payment method you provide.

7. Shipping and delivery

We ship to the contiguous United States only. Delivery times and costs are explained in our Shipping Policy. Risk of loss passes to you when the carrier delivers the order to your shipping address.

8. Returns and refunds

Returns and refunds are handled under our Returns & Refunds policy, which forms part of these Terms.

9. Safety

Perfume is flammable. Keep it away from heat, flames and children, and use it only as directed on the packaging. Stop using a product if irritation occurs.

10. Reviews and content you submit

If you submit a review, question or other content, it must be honest, based on your own experience, and free of unlawful, offensive or misleading material. You give us a non-exclusive, royalty-free license to display it on our website. We do not edit reviews to change their meaning, and we do not remove reviews because they are negative.

11. Intellectual property

The content of this website, including text, images, graphics and logos, belongs to Toda Moda or its licensors. You may not copy or reuse it without our written permission.

12. Acceptable use

You agree not to misuse the website. That includes attempting to interfere with its operation, accessing it by automated means without permission, or using it for any unlawful purpose.

13. Privacy

Our Privacy Policy explains how we collect and use your personal information.

14. Disclaimer

Except as expressly stated in these Terms, and to the fullest extent permitted by law, the website and products are provided "as is" and "as available", without warranties of any kind. Nothing in these Terms limits any rights you have as a consumer that cannot be limited by law.

15. Limitation of liability

To the fullest extent permitted by law, Toda Moda is not liable for any indirect, incidental or consequential damages arising from your use of the website or products. Our total liability for any claim related to an order is limited to the amount you paid for that order. This section does not limit liability that cannot be limited by law.
